1. Rental Agreement & Liability Waiver
This Motorcycle Rental Agreement ("Agreement") is entered into by and between Strathcona Motorcycle Adventures ("Company") and the undersigned individual ("Renter"). By signing this Agreement, the Renter confirms they have read, understood, and agree to all terms and conditions outlined herein. This Agreement becomes effective upon the Renter's signature.
 
2. Eligibility Requirements
- Possess a valid motorcycle-class driver's license.
- Present a major credit card that matches the name on the driver's license.
- International Renters must provide:
  - Valid government-issued ID matching the credit card and license name.
  - Motorcycle license that is valid and recognized by ICBC.
- Wear a DOT-approved helmet at all times while operating the motorcycle.
Note: Failure to meet any of the above requirements will result in cancellation without refund.
 
3. Rental Inclusions
- Unlimited mileage.
- Full-day rental (up to 12 hours for one-day rentals, or 24-hour periods for multi-day rentals).
- Pre-ride orientation and basic safety briefing.
- Emergency contact details.
 
4. Renter Responsibilities
- Familiarize themselves with the specific motorcycle model prior to operation.
- Check tire pressure, chain tension, and oil levels before each ride.
- Immediately report any mechanical or safety issues to the Company.
- Operate and maintain the motorcycle in a responsible and lawful manner.
- Ensure no one other than the approved riders listed in this Agreement operates the motorcycle.
 
5. Fuel Policy
- The motorcycle will be provided with a full tank of 91 Octane fuel.
- Renter must return the motorcycle with a full tank.
- A $40 CAD refueling fee will be charged if returned without a full tank and no prior notice is given.
 
6. Additional Drivers
- Additional drivers are permitted for $25 CAD per rental.
- All additional drivers must meet the same eligibility and license requirements.
 
7. Credit Card & Damage Authorization
- A valid credit card is required and must be securely kept on file for the rental.
- The Renter authorizes Strathcona Motorcycle Adventures to charge the card on file up to $3,000 CAD for amounts owing under this Agreement, including motorcycle or equipment damage, towing, excessive cleaning, late-return fees, missing equipment, fuel charges, traffic-related charges, or other applicable costs.
- No amount will be charged under this authorization unless applicable charges arise.

- The $3,000 CAD card authorization is not insurance and does not limit the Renter's liability under this Agreement. Amounts exceeding $3,000 CAD may be separately recovered from the Renter where applicable.
 
8. Permitted & Prohibited Use
**Permitted Use:** On-road and legal off-road trails only.
**Prohibited Use:**
- Beaches, rivers or water crossings, bike lanes, and race tracks
- Stunts such as burnouts or wheelies
- Illegal or reckless operation
Abuse of the motorcycle, including clutch burning, engine over-revving, or excessive wear, will result in damage charges or early termination.
 
9. Impoundment Liability
- Renter is responsible for all costs related to towing, storage, and legal fees from impoundment.
- Daily rental fees continue until recovery.
 
10. Traffic Violations
- Renter pays all parking and traffic violations.
- $100 CAD administrative fee applies per infraction.
 
11. Damage & Flat Tires
- Renter is liable for punctures or flat tires.
- Company must approve repairs.
- Visible or internal damage from misuse will be charged to the renter.
 
12. Reservations, Payment & Cancellations
- Full payment is required at booking.
Cancellation Policy:
- 10+ days: Full refund minus processing fee
- 10 - 3 days: 50% retained
- Less than 3 days / No-show: 100% retained
 
13. Pick-Up & Return
- Pick-up/return by appointment (9:00 AM-5:00 PM).
- Late return fee: $20 CAD per hour
- No refund for early returns
 
14. Insurance & Liability
- The motorcycle is insured as required by applicable law and the Company’s insurance arrangements. Such insurance does not eliminate or necessarily cover the Renter’s financial responsibilities under this Agreement.

- The Renter remains responsible for damage, loss, towing, recovery, deductibles, and other costs for which the Renter is liable under this Agreement, subject to applicable law and insurance coverage.

- The $3,000 CAD credit card authorization is not insurance and does not represent or limit the Renter’s total potential liability. If applicable costs exceed $3,000 CAD, the Renter remains responsible for any additional amounts for which they are liable under this Agreement.

- The Renter is responsible for confirming whether their own motorcycle, automobile, travel, credit card, or other insurance provides coverage for rental motorcycles. The Company does not guarantee that any personal insurance or credit card coverage will apply.

- BC residents may have optional ICBC coverage that provides protection when renting a vehicle. Renters should confirm eligibility and coverage directly with ICBC or an Autoplan broker before the rental.

- Nothing in this Agreement is intended to require the Renter to pay an amount that is covered and paid by applicable insurance or that cannot lawfully be charged to the Renter.

 
15. Release of Liability
- Acknowledges inherent risks of motorcycle operation
- Accepts full responsibility for actions and consequences
- Releases the Company from all claims, including those caused by negligence
- Commits to returning the motorcycle in the same condition as rented
 
16. Helmet, Jacket and Gloves Rental Terms
- DOT-approved helmets available upon earlier request at **$15/day**.
- Bluetooth communicators are installed where possible on helmets.
- Jacket and gloves are also available upon early request at **$15/day each**.
- Helmets must be returned in the same condition.
- $250 CAD charge applies for lost or damaged helmets and jackets.
 
17. Accessory Add-Ons
Available upon request (subject to availability):
- Luggage cases
- GPS devices
- GoPro or camera mounts
- Additional fees and deposit may apply.
 
18. Rental Extension Policy
- Rental extensions must be requested at least 24 hours in advance.
- Approval is subject to availability.
- Additional charges apply at the daily rental rate.
 
19. Indemnification Clause
Renter agrees to indemnify and hold harmless Strathcona Motorcycle Adventures, its owners, agents, and employees from any and all claims, demands, actions, damages, or liabilities arising out of or related to the rental and operation of the motorcycle.
 
20. Force Majeure Clause
The Company shall not be held liable for delays, cancellations, or failures to perform due to circumstances beyond reasonable control, including but not limited to natural disasters, fires, road closures, accidents, or government restrictions.
